Language Access and Joint Commission Standards
For accredited hospitals and health systems, language access isn’t only a civil-rights obligation — it’s woven into accreditation and quality expectations. Getting it right supports both compliance and patient safety.
The overlapping expectations
Several frameworks point the same direction:
- Section 1557 of the Affordable Care Act requires covered health programs to take reasonable steps to provide meaningful access to LEP patients, using qualified interpreters and translated materials — not untrained bilingual staff, family members, or minors.
- Title VI applies the same principle to federally funded providers.
- The Joint Commission addresses communication as a patient-safety and patient-rights issue, expecting organizations to identify patients’ communication needs and provide language services during care.
- The national CLAS standards (Culturally and Linguistically Appropriate Services) set the benchmark for offering language assistance at no cost, at all points of contact.
What “qualified” means
A qualified medical interpreter is trained in interpreting, medical terminology, and ethics — not simply bilingual. Relying on a family member (especially a child) or an untrained staff member to interpret is both a safety risk and out of step with these standards.
